Welcome to the terms and conditions of Travelxp Red ("Terms"). These Terms shall be between you and Travelxp and/or its associates and shall regulate our respective rights and obligations. Please note that your use of the travelxp.com website and the red membership subscription are both regulated by the agreements specified and linked to below, as well as all other relevant terms, conditions, restrictions and provisions of the website, all of which (as updated over time) are incorporated into these Terms. If you sign up for membership, you agree to certain terms, conditions, restrictions and criteria.
We will sometimes offer trials or other promotional memberships to some customers subject to these Conditions, except as otherwise specified in the related promotional offers. Such a trial or promotional membership may be subject to the conditions laid down by Travelxp. These applicable terms and conditions and the terms and conditions of such promotional membership can vary from those of the Terms. Terms and conditions applicable to Red membership provided for specified duration are available here.
Some of these trials or promotional memberships will only be available to you in the event that Auto Renew Your Red Membership is allowed for your membership.
Red membership can be offered under various terms and conditions. Key memberships are listed as follows:
You may pick your preferred Red Membership Package and at any time alter the plan. The payment method(s) eligible to be used for different Red membership plans may vary, and Travelxp retains the sole right to decide the eligible payment methods for each Red Membership Plan.
The membership fee for Red is set out in the Red section for various membership terms, such as monthly or annual membership, which are offered. The fee is non-refundable, except as expressly provided for in these Terms. Taxes may apply to membership fees.
Your membership will be renewed consecutively for such terms, monthly or annual as chosen by you, (such renewal, "Auto Renewal"), if the payment method you have chosen for making payments towards your membership supports Auto Renewal. In cases where you select an eligible payment method, the payment of the membership fees will be on a recurring basis (such payments, "Recurring Payments") and you authorize us to collect the membership fee for the next membership terms(s).
You have the sole right to decide whether to cancel or disable the Auto Renewal of your Red membership, either by contacting Travelxp Customer Support or by using your Travelxp.com account settings.
You should be a citizen of India or from a country where Travelxp Red is available to register for Red membership. You cannot use a credit or debit card issued outside India to pay any membership charge for Red. You cannot pay Red membership fees using a virtual card or a virtual bank account. Paid Red membership will only become valid upon successful payment authorization or upon successful periodic payment (Auto Renewal of Membership) via the Travelxp.com website (as the case may be).
If Auto Renewal of your Red membership is allowed, your membership will be automatically renewed one after the other for one membership period, unless you specifically chose to cancel or disable Auto Renewal or Recurring Payments for your Red membership.
For the avoidance of doubts, it is clarified that once Auto Renewal has been enabled, monthly Red memberships renew automatically on a monthly basis and annual Red memberships renew automatically on an annual basis.
Red benefits depend on availability and timeframes for booking. On the Travelxp.com website, they are limited to those items. Items eligible for Red will be designated on their product pages as such. For qualifying transactions, such special products, orders, taxes can also apply. You will pay applicable charges for the invalid products if only some items in your order are eligible for Red. Red customers will pay regular charges for products which are not available. Changing or combining offers or preferences can affect Red eligibility.
Travelxp Red offers, including discounts and promotions, cannot be combined with any other ongoing offers, promotions, or discounts, including but not limited to card-specific offers, bank promotions, or other third-party offers, unless expressly stated otherwise. The availability and applicability of any such combinations are subject to change at the sole discretion of Travelxp. Travelxp reserves the right to modify, alter, or withdraw the conditions for combining offers at any time without prior notice. These restrictions form the basis of the discount provided under Travelxp Red unless explicitly modified by Travelxp in writing.
At our discretion, we can also exclude items with special characteristics.
Your paid Red membership will be enabled only on the effective payment of your Red membership via the Travelxp.com website.
You can cancel your Paid Red membership at any time by visiting “Red” and updating your Red membership settings
For the avoidance of doubt, the cancellation process provided under this section, shall apply to you irrespective of whether Auto Renewal or Recurring Payments has been enabled for your Red membership or not.
We may at our discretion, change these Terms, Travelxp.com Terms and Conditions, Privacy Policy, Terms of Use, OTT Terms of Use or any part of Red membership without notice to you.
If any amendment to these Terms is found to be null, void or unenforceable for any reason whatsoever the change shall be invalid and shall not affect the validity and enforceability of any remaining amendments or conditions. If you do not approve to these Terms or any changes made towards them, you must cancel your membership.
We may at our discretion, terminate your Red membership without notice. However, we will not reimburse any termination-related activity that we conclude, in our judgement, violates these Terms or any applicable law, includes fraud or abuse of Red membership, or is detrimental to our interests or any other person. Our failure to insist on or execute your strict compliance with these Terms would not constitute a waiver of any of our rights.
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN TRAVELXP.COM'S T&C, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO RED. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR RED MEMBERSHIP.
